May 28, When Do I Talk About Compensation?

I was hit from behind by a large pickup truck while sitting still in traffic. The metal was all bentup on the front of it and my tire in back of my jeep pressed into the metal tail gate which would not open and close well anymore. The car is being fixed at a body shop and I have a rental. I am filling out paperwork for the guys insurance co. and mine for the no fault. I am injured with a slight whiplash. I feel like I my head is pushing forward and my neck is very stiff. When I move my neck I can hear the bones click. My back hurts and when I try to stand straight it hurts in the lower part of the middle of my back. My arm and shoulder feel strained.

I had a prior injury where I fell at work tripping on a step and flying forward off the 4th step landing hard on my leg causing a knee injury. I have been pulling myself around up the steps because even with a Drs note some the Principals insist on giving me a schedule that requires much stair climbing. I am submitting a second set of paperwork to get an accomodation for elevator schools only not reg.; schools.

I have taken off many days die to the knee and now the neck, etc. I need to make sure I am compensated for these days, etc. I am an ATR which means I would have been looking for a job as a teacher in one school in the fall but could not due to this.

So you actually have multiple issues going on, and I will do my best to assist you with each of them:

First: You have three years in New York, from the date of the accident before you have to close, settle, or bring a lawsuit in this case. This means you have a lot of time to bring this case to a close and work out a settlement.

Second: New York residents are required to have PIP insurance, this means you have PIP. Under your PIP insurance you will have wage compensation available for missed work. So, you will likely have the ability to immediately collect on lost wages due to the accident.

Third: It is way way too soon to start talking about compensation. If you start talking to the insurance now about this, you will end up with a low compensation, with an injury which is not fully healed, and super frustrated.

Fourth: Start with an attorney! An attorney will make sure you get your wages sorted out correctly, an attorney will also make sure your previous injury does NOT lower your settlement. Previous injuries are notorious for causing problems with car accident compensation settlements.

If you have not already talked to the insurance companies, stop talking now to anyone and talk to an attorney. The attorney will make sure your medical history is just that: history, and not something which will get in your way.

Further, its only May. My guess is that you will feel much better by the start of the school term if you start treatment right away. Consistent treatment will make huge difference in how you feel and how you begin to heal.

Treatment: Start with Chiropractic care right away. The chiropractor will look at any x-rays you have and may take some extra x-rays and will start a treatment plan. Chiropractic work brings pain relief right away, you will find things look better as you start working on the pain.

You were in a big accident! Start treatment, get an attorney, you will find both things make a huge difference!
